Pennsylvania Game Commission: Adams Countian Guilty of Using ATV to Chase Deer; Game Law Violations Lead Officers to Other Criminal Activity

HUNTINGDON, Pa., Sept. 2 /PRNewswire/ -- In an act called by one Pennsylvania Game Commission official as "something no one with a conscience could endorse," a McSherrystown resident pled guilty to charges for using an all-terrain vehicle (ATV) to chase a deer to the point of exhaustion and then killing it. Adams County Wildlife Conservation Officer Darren J. David filed the charges.

On Aug. 31, Marshall C. Mixell, 30, pled guilty to unlawful taking and possession of a white-tailed deer before District Judge Daniel Bowman, Bonneauville, and was fined $800. In addition, Mixell is subject to loss of hunting privileges for at least one year.

WCO David was notified by the county dispatch center when an alert citizen reported that a dead deer was being transported on an ATV that was traveling through a farmer's crop fields. The defendant, Mixell, was located with the deer at his friend's home in Conewago Township. He claimed the deer was found after it injured itself crossing a fence and that he killed and removed it as an act of mercy and out of courtesy to the local farmer. However, according to David, the details provided to support Mixell's story of how he got the deer "weren't adding up."

Backtracking on tire marks left by an ATV from the acquaintance's home to a neighboring farm, David was able to determine that Mixell first encountered the deer in open fields and gave chase with his vehicle. By the time the deer had tried to escape over a nearby fence, it was apparently too exhausted to leap the fence that, according to David, was "only about two feet high."

Mixell then went back to the friend's house to retrieve a knife, returned and approached the deer to stab it to death before taking it to the house.

WCO David said that recent high temperatures were probably a contributing factor to the deer's death.

"Most know how hard winter is on wildlife, but heat-induced stress can be just as deadly," David said. "With the hot and humid weather we've been experiencing in Pennsylvania, it wouldn't take much to chase a deer with a vehicle to the point where it could no longer negotiate minor obstacles."

As estimated damages to crops was less than $100, those farmers impacted by the incident told WCO David that they did not wish to pursue additional charges as long as the defendant was charged for the deer.

GAME LAW VIOLATIONS LEAD OFFICERS TO OTHER CRIMINAL ACTIVITY

DALLAS- Pennsylvania Game Commission officials announced that a Pocono Pines resident has been arrested for his alleged involvement in a game law violation and other criminal activity in the Monroe County area.

Jason Horton, 20, was charged with allegedly shooting at or interfering with an active osprey nest. Horton also faces criminal charges for the unlawful possession of a firearm, selling or transferring a firearm to a minor, burglary, criminal trespass and criminal conspiracy. He was arraigned before District Judge Richard Claypool, Pocono Pines, on Aug. 11, and currently is being held in the Monroe County Correctional Facility awaiting trail.

Charges against three juveniles who were with Horton, are pending at this time.

The incident occurred on July 31, in the Forest Glen Development of Pocono Pines. A witness, who is an avid hunter, called the Game Commission Northeast Region in Dallas, after he observed four individuals shooting at or into an active osprey nest, with what he described as a high-powered rifle. At the time of the shooting the nest contained two adult birds along with two juvenile fledglings.

"The caller was able to provide accurate information on the vehicle and its license plate, along with a pretty good description of the four individuals involved," stated Pete Sussenbach, Monroe County Wildlife Conservation Officer (WCO). "Without this information, this violation most likely would have gone unsolved."

Arriving at the nest site, WCO Sussenbach began a search of the area and found spent shell casings from two separate calibers of firearms. Fortunately, no osprey was found dead or injured, however the birds where nowhere to be found.

While WCO Sussenbach was conducting his search of the area for any other clues, Game Commission Dispatcher Diane Grimes was working on determining the owner of the vehicle. As it turned out, the vehicle's owner was a New Jersey resident who also had a local residence within the Pocono Pines community.

WCO Sussenbach, along with officers from Pocono Mountain Regional Police Department, went to the residence and found one of the suspects home. This individual, a 17-year-old male, confessed his role in firing several shots into the osprey nest. He also provided the names of the other individuals, including Horton, who, when interviewed, also admitted to firing at or into the nest. The two other suspects, both juveniles, were located, and gave full confessions to their role in the shooting. Officers were able to secure two firearms -- a .270-caliber bolt-action rifle and 30/30-caliber lever action rifle -- believed used in the violation.

As the investigation began to unfold, it was determined that both firearms seized were stolen from a local residence in a reported burglary that occurred a week earlier. Evidence gathered by Pocono Mountain Police Detective Steven Mertz from this and several other recent home burglaries in the immediate area indicate a connection with some of these individuals.

"Fortunately, none of the birds was killed or injured," stated WCO Sussenbach. "They all returned to the nest area within a few days of the incident. I'll never understand why some people do something like this."

Ospreys, also known as "fish hawks," are large eagle-like hawks. They are primarily fish-eaters and, in areas of good habitat, can be seen diving from the sky into the water to catch prey. They currently are listed as a "threatened species" in Pennsylvania, but in recent years they have made considerable progress on the road to recovery. Their population, like other birds of prey, was devastated by the widespread use of the now-banned pesticide DDT.

The Game Commission, in cooperation with East Stroudsburg University, Wild Resources Conservation Fund and local Audubon Society chapters, worked to restore ospreys to the Commonwealth in the early 1980s through a pioneering hacking program, similar to the one used to fuel Pennsylvania's bald eagle recovery.

The first Pennsylvania-hacked osprey returned in 1983, and two years later the state documented its first nesting pair since 1910. Additional reintroduction efforts were sponsored by the U.S. Army Corps of Engineers at the Tioga-Hammond Dams, and by the Morraine Preservation Fund in Butler County. Ospreys were down-listed from endangered to threatened in 1998 in response to the success for these programs. Today, more than 50 pairs of ospreys are nesting in the state.

"Ospreys still are a fragile species in our Commonwealth," said WCO Sussenbach. "They have made a remarkable comeback, especially in the Pocono Mountain area, but there is still plenty of unoccupied habitat waiting for ospreys to use. Until they move into these areas, we'll continue to consider these birds a species of special concern."

Lawsuit alleges that proposed new ATP rules to aid doubles circuit would actually rig tournaments in favor of singles players, turning doubles matches into marketing tools to promote the star-studded singles circuit

HOUSTON, Sept. 2 /PRNewswire/ -- The best tennis doubles players in the world have joined together to file a lawsuit against the ATP Tour, Inc. (ATP) to "save doubles" and preserve the tradition and integrity of the sport of tennis.

The lawsuit, filed in a Texas federal court, alleges that the ATP's efforts to purportedly "enhance" doubles competition is in fact a concerted effort by tournament directors to run the best doubles players out of the game. The alleged actual aim is to turn the doubles circuit into nothing more than an exhibition marketing tool for the promotion of singles tournaments. The suit also alleges that the ATP's directors have violated their fiduciary obligations to the players by enacting rules that prevent doubles players from competing, contrary to the express wishes of the players. Ironically, the ATP, which has governed the professional tennis tour since 1990, was formed to promote and protect the future of the sport and to give tour players a voice in their sport. The suit was filed on September 1 in the midst of the U.S. Open, the highest-attended tennis tournament in the world, in which the plaintiff players are participating.

The international law firm of Fulbright & Jaworski L.L.P. and the Houston-based firm of Ellis, Carstarphen, Dougherty & Goldenthal P.C. have teamed up to bring the suit in the U.S. District Court for the Southern District of Texas on behalf of the highest-ranked doubles stars.

The plaintiffs, who are among the game's best, include:

* Bob and Mike Bryan, U.S. standouts and twin brothers who were ranked
no. 1 in 2003 and most of 2005;
* Mark Knowles and Daniel Nestor, the number-one ranked team in 2002 and

* Mahesh Bhupathi, another former no. 1 doubles player;
* Graydon Oliver, a former NCAA champion and tour standout who is fast

Some of the players filing suit and their attorneys will hold a press conference at the U.S. Open tournament site in Flushing Meadows, New York on Friday, September 2 at 10:00 a.m.

The complaint seeks injunctive relief to stop the ATP's and its directors' alleged unlawful and anticompetitive conduct against athletes who excel in doubles. The players charge the ATP and its directors with antitrust violations and breaches of fiduciary duties.

After the recent Wimbledon matches, the ATP announced fundamental changes to the rules concerning scoring in doubles as well as how players would qualify for doubles tournaments. The players claim the ATP, controlled by self-interested tournament directors, has unfairly changed the system to exclude doubles players in favor of singles players, upsetting long traditions in the sport. The new rules completely divorce entry requirements from past competitive success in doubles competition. The players were flabbergasted by the announcement especially given that the Players' Council (comprised of mostly singles players and a few doubles players) voted 8-0 against the doubles reform.

Mike Bryan, one-half of the dynamic and fan-friendly U.S. team stated: "They are monkeying with the integrity of the game. Ninety-nine percent of the players whom I've talked to think it's going to be bad for doubles and fans. People are going to lose a lot of respect for doubles. The players voted against it and the tournaments passed it [anyway]."

Under the new rules, doubles experts, who train and play an event with unique requirements as compared to the singles game, will be required to qualify for the singles tournament before being eligible to compete in ATP doubles tournaments, no matter how successful they have been in prior doubles competition.

A Rigged Match

Under the new regime, doubles Grand Slam champions would be denied entry into tournaments if they did not also qualify for the singles draw beginning in 2008. However, because of the special requirements to excel at the highest level of doubles, most of the top doubles players do not play the singles events. If the rules are implemented as planned, the result will be that a century old sporting event enjoyed by millions of players around the world today -- doubles tennis -- will virtually disappear as serious competition at the professional level.

"These so-called 'reforms' are nothing more than the latest, but most outlandish, step in the ATP's effort to get rid of today's doubles stars," said John F. Sullivan III, a partner in Fulbright's Houston office. "Unfortunately for our clients, as well as the entire sport of tennis and its fans, a small number of ill-advised and self-interested directors of the ATP are not only attempting to unlawfully take away the livelihood of the best doubles' players in the world, they are also seriously harming a sport that millions of people love to watch and play.

"They have failed miserably to promote doubles," continued Mr. Sullivan. "In retrospect, that is actually part of their overall scheme to get rid of the event so they won't have to compete for players in that market -- thus putting more money into their own pockets. Worse, these directors have flaunted their misguided intentions without even acknowledging their fiduciary duties to the players and members of the APT, which they don't seem to appreciate includes the doubles stars."

The new requirements will not extend to the four major Grand Slam events, which are governed by the International Federation of Tennis, but the effect of the rules will keep most doubles stars out of competition in those events too based upon the ranking system. If double players are prohibited from playing ATP events because their singles rankings are not high enough to secure entry to singles draws, they will lack the ATP standing to be eligible for doubles draws at the Grand Slam events.

The players have also started a non-profit entity called "Save Doubles" because of the expressed interest of so many fans who want to contribute financially to support these great players and the sport. Save Doubles Tennis Files Lawsuit Against ATP Tour, Inc.

HOUSTON, Sept. 1 /PRNewswire/ -- The best doubles players in the world have joined together to file a lawsuit against the ATP Tour, Inc. (ATP) to "save doubles" and preserve the tradition and integrity of the sport of tennis. Ironically, it is the ATP that governs the professional tennis tour, formed in 1990, to, among other things, "promote and protect the future of the sport of professional tennis" and to give tour players a voice in their sport. The suit was filed earlier today on the fortnight of the U.S. Open, the highest attended tennis tournament in the world, in which the plaintiff players are participating. Some of the top players in the suit and their attorneys will hold a press conference at the tournament site in Flushing Meadows, New York on Friday, September 2 at 10:00 a.m. E.T. The lawsuit alleged that the ATP's efforts to purportedly "enhance" doubles is in fact a concerted effort by tournament directors to run the best doubles players out of the game and turn the doubles circuit into nothing more than an exhibition marketing tool for tournament directors to promote their singles tournaments. The lawsuit also alleges that the ATP's directors have violated their fiduciary obligations to the players by enacting rules that prevent doubles players from competing, contrary to the express wishes of the players.

The international law firm of Fulbright & Jaworski L.L.P. and the Houston- based firm of Ellis, Carstarphen, Dougherty & Goldenthal P.C. have teamed up to bring the suit in the U.S. District Court for the Southern District of Texas on behalf of the highest ranked doubles stars, including U.S. standouts and twin brothers, Bob and Mike Bryan who were ranked no. 1 in 2003 and most of 2005, Mark Knowles and Daniel Nestor, the number one ranked team in 2002 and 2004, Mahesh Bhupathi, another former no. 1 player, Graydon Oliver, a former NCAA champion and standout on the tour who is fast rising in the rankings, as well as Houston resident twin brothers and former NCAA Champions, Richard and Will Barker, who joined the tour in 2004, among numerous others of the game's best. The complaint seeks injunctive relief to stop the ATP's and its directors alleged unlawful and anticompetitive conduct against athletes who excel in doubles. The players charge the ATP and its directors with antitrust violations and breaches of fiduciary duties.

CHARLOTTESVILLE, Va., Sept. 1 /PRNewswire/ -- Athletics Directors Craig Littlepage of the University of Virginia and Jim Weaver of Virginia Tech announced Wednesday that the two schools will partner with Adelphia Communications to begin the Commonwealth Challenge during the 2005-06 academic year.

The Commonwealth Challenge is designed as a friendly rivalry series between the schools' athletics programs on an annual basis that continues the growing relationship between the two in-state members of the Atlantic Coast Conference.

The Commonwealth Challenge is a comprehensive competition involving teams in the two schools' athletics programs. With Adelphia's support, it is designed to increase the exposure and interest level in the various sports, while promoting good sportsmanship among student-athletes, coaches and fans of the schools. A point system determines the annual winner of the competition.

"The Commonwealth Challenge will be a unique way for fans to follow all of the sport competitions between Virginia Tech and UVa," Weaver said. "It will add to the excitement of the competition between our schools. We are excited about this annual athletic challenge."

The trophy will be presented at the Commonwealth Day football game between the two schools the following fall. There are also traveling plaques for the winning team in each sport.
